Eminent Domain & Condemnation

Eminent domain is the right of the government to seize private property for public use, in exchange for payment of fair market value.  Condemnation is the actual government seizure of private property based on the right of eminent domain.  Under Texas law, legal actions for eminent domain begin with an administrative hearing.  The hearing is held before a panel of Special Commissioners appointed by a judge.  The purpose of the hearing is to determine the fair value of property.  Similar to a trial, the landowner may present evidence in regard to the land’s value in addition to any evidence that shows that the value of remaining property would be diminished if the government is only acquiring a portion of the entire property. Obtaining legal counsel for preparation of evidence and representation in the hearing helps protect a landowner both financially and in terms of legal rights.
