Inverse Condemnation
Inverse condemnation is government seizure of a portion of property that damages the value of the entire property, making the seizure equivalent to condemnation of the property. Inverse condemnation is a lawsuit brought by the landowner against the government seeking payment of fair market value for the entire property. An example of inverse condemnation would be the following: the government is building a road and seizes property that was being used as a store parking lot in order to build its road. The storeowner could argue that since his customers no longer have anywhere to park, the value of the whole business is diminished, making the business no longer viable. The government may be obligated to pay the storeowner the value of the property acquired and damages to the remaining property.
