Exaction is another type of real estate issue that often arises. Exaction is a government attempt to mitigate development effects on existing and proposed municipal infrastructure. An example may involve a city requiring a developer to alter an existing two-lane asphalt road to a six-lane divided concrete thoroughfare to accommodate the effects of the proposed development.
Regulatory taking is a real estate issue that our attorneys deal with that is similar to inverse condemnation. Through excessive or extreme land use restrictions, the government may devalue a property, tantamount to a “taking,” and hence the name, “regulatory taking.” Regulatory takings violate a landowner’s rights. Lawsuits may be brought against the government under Federal Statute 42 U.S.C. § 1983 Civil Rights for violations of the Fifth and Fourteenth Amendments of the U.S. Constitution regarding due process, equal protection of laws and fair compensation for property.
